Retreat Waiver and Cancellation Policy

TERMS AND CONDITIONS OF PARTICIPATION AND LIABILITY WAIVER

PLEASE READ CAREFULLY. BY CHECKING THE BOX ON THE TICKETING PAGE, YOU ARE AGREEING TO THESE TERMS AND CONDITIONS.

  1. Introduction and Scope
    By purchasing a ticket and checking the box to indicate acceptance of these Terms and Conditions (“Agreement”), you (“Participant”) voluntarily agree to participate in a leadership development retreat program (“Event”) organized and hosted by the individual(s) or entity providing the training, lodging, activities, and other related services (“Host”). The Event may include, but is not limited to, workshops, group discussions, recreational activities, overnight accommodations, and meals.

  2. Voluntary Participation and Assumption of Risk
    (a) Voluntary Participation: Participant acknowledges that participation in the Event is entirely voluntary.
    (b) Assumption of Risk: Participant understands that the Event may involve physical, mental, and emotional activities that carry certain inherent risks and hazards. These risks may include, but are not limited to, personal injury, illness, property damage, emotional distress, or other losses arising from or related to activities such as hiking, using hot tubs, saunas, participating in escape rooms, and consuming meals or beverages. By checking the box, Participant knowingly and freely assumes all such risks, both known and unknown.

  3. Outdoor Activities and Wilderness Conditions
    Participant acknowledges that portions of the Event may take place outdoors, in wilderness or natural settings. Participant understands that outdoor activities may involve uneven terrain, exposure to weather elements, wildlife encounters, and other unpredictable natural conditions. Participant agrees to exercise caution and follow all safety instructions provided by Host or its representatives. By participating, Participant assumes all risks associated with outdoor and wilderness activities, including but not limited to falls, insect bites, animal encounters, adverse weather, and other natural hazards.

  4. Health and Medical Considerations
    Participant certifies that they are in sufficient physical and mental health to safely engage in the Event’s activities. Participant agrees to notify Host, in writing and in advance, of any medical conditions, allergies, or dietary restrictions. Participant understands that the Host may not provide on-site medical professionals and that emergency medical services may not be immediately available. Participant agrees to assume all costs associated with any medical treatment.

  5. Release, Waiver, and Discharge of Liability
    (a) General Release: To the fullest extent permitted by law, Participant, by checking the box, releases, waives, and discharges Host, its owners, members, directors, officers, employees, agents, contractors, successors, assigns, insurers, and affiliated entities (“Released Parties”) from any and all liability, claims, demands, actions, damages, or causes of action of any kind, whether known or unknown, that arise out of or relate to Participant’s participation in the Event. This includes, without limitation, claims for personal injury, property damage, emotional distress, wrongful death, or economic loss.
    (b) Scope of Release: This release applies to all claims and liabilities caused in whole or in part by the negligence of the Released Parties, except for willful or grossly negligent acts.

  6. Indemnification and Hold Harmless
    Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of Participant’s acts or omissions in connection with the Event, including claims made by third parties.

  7. Compliance with Rules and Instructions
    Participant agrees to follow all rules, policies, and instructions provided by Host or its representatives during the Event. Participant acknowledges that noncompliance may result in dismissal from the Event without refund.

  8. Photographs, Recordings, and Intellectual Property
    By checking the box, Participant grants Host and its representatives a perpetual, irrevocable, worldwide, royalty-free license to take, use, reproduce, edit, distribute, display, and create derivative works from any photographs, video, or audio recordings (“Media”) taken at or in connection with the Event that include Participant’s likeness, voice, image, or statements. These uses may be for any purpose related to the Host’s business, including but not limited to marketing, promotional materials, educational resources, social media, and website content, without additional compensation or further notice.
    Participant acknowledges that all Event-related materials (including program content) are the property of Host or its licensors and may not be reproduced, distributed, or used outside the scope of the Event without express written permission.

  9. Choice of Law and Venue
    This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any claim or dispute arising out of or relating to this Agreement or the Event shall be brought exclusively in a state or federal court located in Ohio. Participant consents to the personal jurisdiction and venue of such courts.

  10. Severability and Entire Agreement
    If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain enforceable. This Agreement represents the entire understanding between Participant and Host regarding the Event and supersedes all prior or contemporaneous representations, understandings, or agreements.

  11. Acknowledgement of Understanding
    By checking the box on the ticketing page, Participant acknowledges that they have read, understood, and agreed to these Terms and Conditions. Participant further acknowledges that they are at least eighteen (18) years of age and legally competent to enter into this Agreement.

Cancellation Policy

1. General Policy:
We understand that unexpected circumstances can arise, and we strive to be fair and transparent while also protecting the Host’s ability to plan and execute the Event effectively. This cancellation policy outlines the terms under which refunds or credits may be provided.

2. Timing of Cancellations:

  • More than 30 days before the Event start date: Participant may cancel their attendance and receive a full refund of the ticket price paid, minus a reasonable administrative fee to cover processing costs.
  • Between 14 and 30 days before the Event start date: Participant may cancel their attendance and receive a 50% refund of the ticket price paid.
  • Less than 14 days before the Event start date: Due to the Host’s advance commitments for accommodations, meals, materials, and staffing, no refund will be issued. However, if the Participant notifies the Host in writing, the Host may, at its sole discretion, issue a credit toward a future Event of similar value, subject to availability and any applicable price differences.

3. Substitutions:
In lieu of cancellation, a Participant who cannot attend may transfer their ticket to another qualified individual by notifying the Host in writing at least 7 days prior to the Event start date. All terms and conditions of participation, including this policy and the liability waiver, will apply to the substitute Participant.

4. Event Modifications or Cancellations by Host:
The Host reserves the right to cancel the Event entirely or make significant changes to the Event schedule or venue if circumstances beyond the Host’s control make it necessary (e.g., severe weather, venue closure, or other uncontrollable events). In such cases, the Host will offer a full refund of the ticket price or provide an opportunity to transfer the Participant’s registration to a rescheduled Event of equal value. Additionally, the Host reserves the right to modify portions of the program content, activities, or presentations if the Host determines that such changes will enhance the overall quality or relevance of the Event. Any refunds or credits under these circumstances apply only to the ticket price paid and do not include reimbursement for travel, lodging, or other personal expenses.

5. Notification Process:
All cancellation or substitution requests must be submitted in writing via email to the Host. The effective date of cancellation will be the date the Host receives and acknowledges the written request.

6. Final Interpretation:
The Host reserves the right to make the final determination on all cancellations, refunds, and credits. The goal is to ensure fairness and flexibility while maintaining the ability to deliver a high-quality Event experience.

Camp because I said I would
Cabin Rental Agreement

This Cabin Rental Agreement (the “Agreement”) is entered on day the reservation is made between Camp because I said I would (“BISIW”), and (the “Cabin Renter”).  For purposes of this Agreement, the phrase “Cabin Renter” shall include the group itself along with all of its affiliated individuals, agents, contractors, directors, employees, guests, invitees, officers and members; and “Premises” shall mean the facilities of Camp because I said I would located at 3483 McCament Road, Walhonding, OH 43843.

Upon full payment of all scheduled fees and the execution of this Agreement, BISIW agrees to provide the Premises for the following term (the “Term”):

            Any changes to these times must be agreed upon in writing or via email with an authorized BISIW representative.

By clicking, you agree to the Terms and Conditions of this Rental Agreement. There may be multiple groups using 'Because I Said I Would' facilities or programs at any given time.

Cabin Renter is solely responsible for all harm, damage or losses caused by it, its members and/or its use of BISIW property. This includes but is not limited to (1) Camp because I said I would real property, the Premises, buildings, fixtures, improvements, personal property, buildings, tents, equipment and grounds; (2) Cabin Rental member(s) or other invitee(s), group member(s) or their property; and (3) all other individuals and property upon campgrounds. BISIW is not responsible for any damage or loss of personal property or merchandise left at the facility prior to, during, or after an event. 

Cabin Renter further agrees with the following:

  1. Cabin Renter shall not use or occupy the Premises, or any other part of Camp because I said I would, for any unlawful purpose and shall fully comply with all applicable laws, regulations, ordinances, rules and legal mandates and prohibitions.
  2. Cabin Renter may not assign this Agreement, nor sublet the Premises or any part thereof.
  3. Cabin Renter shall permit BISIW, its agents or employees, to enter the Premises, at all reasonable times, to examine the condition of the same. At the end of the event, anything moved from its original location must be returned to its original location (i.e., tables, chairs, picnic tables from under the shelter house, table and chairs taken outside, etc.).
  4. Cabin Renter will use and occupy the Premises and Camp because I said I would in a careful, staid, and proper manner and will surrender and return the Premises, at the end of the Term, in good order and in pre-event condition.
  5. Cabin Renter acknowledges this Agreement is made without any warranty of any kind, express or implied, as to the condition of the Premises, Camp because I said I would or any part thereof.
  6. Cabin Renter acknowledges pets, or other animals are prohibited from the Premises and Camp because I said I would, unless otherwise stated with written permission from Camp BISIW.
  7. Cabin Renter acknowledges employees, agents, invitees, guests, members, or others to park their motor vehicles only in designated parking lot areas.
  8. Cabin Renter shall provide at the time of check-in a list of all guests including their name, age, home address, telephone number and emergency contact information.
  9. Cabin Renter is prohibited from bringing any firearms, pellet or bb guns, hunting, and bow firing of any kind on the Premises and Camp because I said I would
  10. Cabin Renter is prohibited from the possession and/or use of any illegal drugs on the Premises and Camp because I said I would.
  11. Cabin Renter is prohibited smoking of any tobacco products or vaping of any kind inside the cabins or any building at Camp because I said I would. Smoking inside a cabin or building will result in a $500 fee automatically charged to Cabin Renter.
  12. Cabin Renter acknowledges and agrees that some equipment, supplies and activities may not always be available due to other guest usage, malfunctions or needed repair time. If Cabin Renter fails to return equipment and supplies, Cabin renter agrees to pay for the replacement cost of equipment and supplies.
  13. Cabin Renter acknowledges that the use of open flames, other than for cooking and controlled fires in the corresponding fire pit, is prohibited as is confetti and glitter. It is also not permitted to hang décor from the ceiling.
  14. Cabin Renter may encounter wildlife and sensitive plants (ex. poison ivy) and are to use caution. When hiking or camping, it will:

                 -Plan ahead and prepare                                                                    -Minimize campfire impacts                                    

                -Travel and camp on durable surfaces                                               -Respect wildlife

                -Dispose of waste properly                                                                -Be considerate of other visitors

                -Enforce Leave No Trace principles

15. Cabin Renter is responsible for the safety and care of its affiliated individuals, agents, contractors, directors, employees, guests, invitees, officers and members, including  first aid, emergency care, and emergency transportation. It is recommended that Cabin Renter provides someone who is certified in CPR and First Aid. 16.Cabin Renter acknowledges use of the pond is ONLY permitted with the following regulations: No swimming is allowed. Guests who are found swimming may be asked to leave the property and no refund will be granted. Cabin Renter and their guests may use canoes and kayaks from dawn until dusk (i.e., during sunlight hours). Life jackets must be always worn by everyone while on the water. Children under 14 must be always accompanied by an adult while on the property and while on a watercraft.

17. No golf carts, all-terrain vehicles or motorized bikes or scooters are permitted.
